Democrats on the Senate Banking Committee are calling for a bipartisan public hearing on prediction markets. The group, led by Senator Elizabeth Warren, opposed the Republican-only meeting held with Kalsi on the 23rd of September. 

In a letter to Senate Banking Committee chair Tim Scott, the group said, 

It is critical that Congress examine prediction markets on a bipartisan basis in a public hearing – not behind closed doors in a Republican-only, industry-friendly roundtable.

The group added that prediction markets touching corporate performance indicators are security-based and should be “subject to SEC regulation.”

Warren and the team insisted that the panel has a “critical oversight role to play” and called for transparency, including public hearings that involve all committee members. 

The letter was sent to Chair Scott, the same day they held private talks with Kalshi. In his defense, Scott said the meeting was to “better understand the opportunities and challenges presented by securities-linked products.”

He added, 

We discussed the importance of bringing innovation onshore, how investors use these products, ways to protect retail investors, and the regulatory questions Congress should address.

Will $50B prediction markets suffer CLARITY Act’s fate?

It’s not yet clear whether the recent friction was tied to the recent Democrats’ holdout and stalling of the CLARITY Act. However, the prediction markets are a booming segment that could face regulatory headwinds if the bipartisan approach falters. 

In fact, reporter Jeff Roberts also warned about crypto political spending against Democrats in retaliation for voting down the CLARITY Act. 

It’s poor strategy to wage a vendetta when Dems are poised to retake the House and maybe the Senate. Big Crypto should grow up and do the same (play the long game like oil and pharma sectors).

Already, some states view part of the market, especially those involving sports bets, as 100% gambling that should be under their control. Traditional sports betting firms are also against prediction markets’ overtures. 

But the CFTC disagrees with states, insisting that the federal regulator hold sole oversight in the segment. In fact, the regulator submitted a proposed rulemaking for event contracts to the White House. 

Although President Trump has voiced support for CFTC oversight in the sector, the review has not been finalized since its May submission. 

That said, prediction markets are a $50 billion monthly volume market with over $1 billion in Open Interest. Notably, politics and sports dominate the trading activity.

The market has increasingly come under scrutiny over insider trading, manipulation, and the legal war over oversight control between the CFTC and states. It remains to be seen how Democrats’ push for SEC oversight will redefine the segment.
