Trump could net big tax windfall

As pledged during the election campaign, U.S. President Donald Trump has become a pro-crypto U.S. president. But in addition to that, his financial connections to the cryptocurrency sector and his support of significant crypto legislation in Congress are now drawing criticism. 

Lawmakers from both parties have raised concerns about conflicts of interest. They argue that Trump’s role in shaping crypto policy could overlap with his personal crypto holdings. Some senators have therefore proposed an ethics clause that would require him to sell those assets.

How will the ethics clause affect Trump’s crypto holdings?

In most cases, capital gains tax is triggered when appreciated assets are sold.

Trump’s crypto holdings have probably grown in value to $1.456 billion, marking $88 million in profit, so unless a tax-deferral clause is included, a forced sale could result in a sizable tax bill. 

Therefore, the proposed ethics clause would allegedly permit Trump to postpone paying those capital gains taxes instead of paying them all at once, according to Bloomberg.

This matters because tax deferral only delays the due date of taxes, not their elimination.

Why are lawmakers divided over Trump’s proposed crypto tax deferral?

The proposal aims to shield public officials from an immediate tax bill when ethics rules require them to divest assets.

Critics argue that the provision could give Trump a substantial financial advantage. Supporters see it as a standard safeguard for officials forced to sell investments.

Bloomberg reported that the White House and lawmakers were still negotiating the ethics addendum. They had not released its text publicly.

Its final language, eligibility rules, and tax treatment could still change before lawmakers introduce or vote on the legislation.

The debate follows seven draft crypto tax bills reviewed during a House Ways and Means Committee hearing in June.

Will this concern further delay the CLARITY Act?

Now, with such provisions and actions in play, the CLARITY Act seems to be a necessity to provide regulatory certainty and promote broader crypto adoption and institutional participation. 

However, with the most recent Senate schedule indicating that the Clarity Act (H.R. 3633) is not an immediate legislative priority, uncertainty around approval has grown further.
