Tom Emmer, the Majority Whip in the U.S. House of Representatives, is arguing that the CLARITY Act is necessary to give the digital-asset industry a clear and consistent legal framework.

He also stressed the fact that the House has spent more than five years working on the bill. Hence, Emmer is now urging the U.S. Senate to pass the bill, suggesting that the House has already done its part and that Senate approval is the key remaining step before the legislation can move forward. 

He said

It was passed more than a year ago with almost 100 Democrats, and yet it still languishes over in the Senate. They can’t seem to get it moved.

Warren is the biggest critic of the CLARITY Act

However, according to Senator Elizabeth Warren, the most recent draft of the CLARITY Act has five significant flaws.

She argues that the bill could weaken investor protections, create gaps in securities regulation, and raise risks involving illicit finance and taxpayer exposure.

According to Warren, the bill also flags potential conflicts of interest involving the president and concerns over pension funds holding digital assets.

Additionally, the CLARITY Act is also facing growing resistance in the U.S. Senate from regional and community banks. 

Moreover, Zach Pandl, Head of Research at Grayscale, recently argued that even if the CLARITY Act fails to become law in 2026, the U.S. crypto industry is unlikely to stop growing. 

What’s ahead amidst dropping Polymarket odds?

With a 15th September vote now expected, continued banking opposition could still lead to amendments or further delays. This comes as Polymarket odds have dropped to 21%, suggesting that approval is not looking optimistic.

However, former U.S. Defense Secretary Mark Esper still believes in the potential of the CLARITY Act, as he recently noted,

The Clarity Act, now before the Senate, is not merely a financial services bill. It is also a national security bill, and it should be understood as such and passed with urgency.
