CLARITY Act faces September deadline after Senate delay – Reasons

Can regulators save the sector as the bill's chance of passage in 2026 drop to a record lowest of 14%?

The much-awaited Senate floor vote for the crypto bill, the CLARITY Act, has been pushed to September after missing the August window. 

Senate Majority Leader John Thune expects Senators to stay in Washington over the weekend or early next week. A cloture filing on the legislation (a procedural move) that can allow the bill to advance to a Senate floor vote could be possible.

But the final vote may happen next month, Thune told reporters on Thursday. 

The Dems insisted on no Clarity vote. We’re getting that queued up first thing when we come back in September.

Why was the CLARITY Act Senate vote delayed until September?

Earlier on Thursday, the 6th of August, Democratic member Sen. Elizabeth Warren maintained that they want legislation for the sector. However, she opposed the current draft CLARITY Act, 

We need crypto legislation. I’ve been saying this for a long time. But crypto legislation that has been written by the crypto industry to protect and advance the crypto industry…that’s just not good crypto legislation.

Warren had also pressed the SEC to investigate Trump memecoin for being a potential rug pull and illegal scam. Many analysts viewed this as part of a broader agenda to push for strong ethics provisions, a key sticking issue in the CLARITY Act. 

For his part, Cardano founder Charles Hoskinson slammed the Warren-led Democratic faction, adding that,

So she would rather have legislation to damage and destroy the industry? There is no compromise with people like Liz. She wants to ban all cryptocurrencies and blockchain technology.

Will the CLARITY Act become law in 2026?

The CLARITY Act is the most comprehensive crypto market structure legislation in the U.S and was advanced out of the House last July. The Senate Banking Committee cleared its amended version of the bill in May 2026. 

However, the final Senate floor vote has been elusive amid a fight over the bill’s provisions on stablecoin yield, illicit finance, developer protections and ethics. 

Some Republicans have also withheld support, meaning that without Democrats’ backing, the bill could stall for a while. 

The Senate will resume session on 14th September and go for another month-long recess in October. This leaves only September and November as another shot for the bill’s passage.

But the chance of passage this year fell to a record low of 14%. On the bill’s outlook, Vincent Chok, founder of First Digital (issuer of FDUSD stablecoin), told AMBCrypto, 

The CLARITY Act’s delay creates extended uncertainty around market structure, custody, and oversight at a time when institutions are looking for clear frameworks.

The industry is hopeful it can survive with rulemakings and guidelines from pro-crypto SEC and CFTC. 

But the risk is that a new Democratic administration could reverse the agency guidelines, warned Maylea Ma, Deputy General Counsel at 1inch, and Bitwise CIO Matt Hougan.
